New EPA website compiles agency cancer prevention efforts

On September 13, the US Environmental Protection Agency (EPA) added to its website a portal with information about the agency’s many regulatory, research and informational efforts addressing carcinogen hazards and controls. This information supports the Biden Administration’s “Cancer Moonshot.”  EPA undertakes carcinogen control efforts by applying legal authority under many of the environmental protection statutes it administers. Circuit Court sends Roundup pesticide review back to EPA for another try

On June 17, the Ninth Circuit (federal) Court of Appeals issued an important ruling on national pesticide regulation, directed at the chemical glyphosate, which is the active ingredient in the ubiquitous weedkiller Roundup (originally marketed by Monsanto, which was bought by Bayer in 2018). The order remands to the Environmental Protection Agency (EPA) the agency’s determination that glyphosate does not pose “any unreasonable risk to man or the environment,” citing evidence that such risks may indeed be present. The case, Natural Resources Defense Council v. EPA, interprets and applies the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). This decision is the latest step in controversies dating to 2009, when EPA began its latest FIFRA hazard review and reregistration determination for glyphosate.

After 15 years of controversy, Circuit Court gives EPA 60 days to rule on Chlorpyrifos pesticide

On April 29, the Ninth Circuit (federal) Court of Appeals issued an important ruling on national pesticide regulation, directed at the controversial organophosphate insecticide chlorpyrifos. The order directs the Environmental Protection Agency (EPA) to act within 60 days to either announce an enforceable safe exposure level for use, or to ban the pesticide. The case, League of United Latin American Citizens (LULAC) v. Regan, interprets and applies the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), and related authority under the Federal Food, Drug, and Cosmetic Act (FFDCA). This decision is the latest step in controversies dating to 2006, involving years of EPA inaction spanning the Obama and Trump administrations.
